গণপ্রজাতন্ত্রী বাংলাদেশের সংবিধানে চিন্তা, বিবেক ও বাক-স্বাধীনতা নাগরিকগণের অন্যতম মৌলিক অধিকার হিসেবে স্বীকৃত এবং তথ্য প্রাপ্তির অধিকার চিন্তা, বিবেক ও বাক-স্বাধীনতার একটি অবিচ্ছেদ্য অংশ। জনগণ প্রজাতন্ত্রের সকল ক্ষমতার মালিক ও জনগণের ক্ষমতায়নের জন্য তথ্য অধিকার নিশ্চিত করা অত্যাবশ্যক। জনগণের তথ্য অধিকার নিশ্চিত করা হলে সরকারি, স্বায়ত্তশাসিত ও সংবিধিবদ্ধ সংস্থা এবং সরকারি ও বিদেশি অর্থায়নে সৃষ্ট বা পরিচালিত বেসরকারি সংস্থার স্বচ্ছতা ও জবাবদিহিতা বৃদ্ধি পাবে, দুর্নীতি হ্রাস পাবে ও সুশাসন প্রতিষ্ঠিত হবে। সরকারি, স্বায়ত্তশাসিত ও সংবিধিবদ্ধ সংস্থা এবং সরকারি ও বিদেশি অর্থায়নে সৃষ্ট বা পরিচালিত বেসরকারি সংস্থার স্বচ্ছতা ও জবাবদিহিতা নিশ্চিত করা সমীচীন ও প্রয়োজনীয়। ঠিক এ উদ্দেশ্যে তথ্য অধিকার আইন প্রণয়ন করা হয়েছে। এ আইন তথ্য অধিকার আইন, ২০০৯ নামে অভিহিত।
এ আইনে “তথ্য” বলতে কোনো কর্তৃপক্ষের গঠন, কাঠামো ও দাপ্তরিক কর্মকান্ড সংক্রান্ত যে কোনো স্মারক, বই, নকশা, মানচিত্র, চুক্তি, তথ্য-উপাত্ত, লগ বহি, আদেশ, বিজ্ঞপ্তি, দলিল, নমুনা, পত্র, প্রতিবেদন, হিসাব বিবরণী, প্রকল্প প্রস্তাব, আলোকচিত্র, অডিও, ভিডিও, অংকিতচিত্র, ফিল্ম, ইলেকট্রনিক প্রক্রিয়ায় প্রস্তুতকৃত যে কোনো ইনস্ট্রুমেন্ট, যান্ত্রিকভাবে পাঠযোগ্য দলিলাদি এবং ভৌতিক গঠন ও বৈশিষ্ট্য নির্বিশেষে অন্য যে কোনো তথ্যবহ বস্তু বা তাদের প্রতিলিপিও এর অন্তর্ভুক্ত হবে:
তথ্যের অধিকারঃ
এ আইনের বিধানাবলী সাপেক্ষে, কর্তৃপক্ষের নিকট হতে প্রত্যেক নাগরিকের তথ্য লাভের অধিকার থাকবে এবং কোনো নাগরিকের অনুরোধের প্রেক্ষিতে সংশ্লিষ্ট কর্তৃপক্ষ তাকে তথ্য সরবরাহ করতে বাধ্য থাকবে৷ এর জন্য এ আইনের অধীন তথ্য অধিকার নিশ্চিত করার লক্ষ্যে প্রত্যেক কর্তৃপক্ষ তার যাবতীয় তথ্যের ক্যাটালগ এবং ইনডেক্স প্রস্তুত করে যথাযথভাবে সংরক্ষণ করবে। প্রত্যেক কর্তৃপক্ষ যে সকল তথ্য কম্পিউটারে সংরক্ষণের উপযুক্ত বলে মনে করবে সেসব তথ্য, যুক্তিসংগত সময়সীমার মধ্যে, কম্পিউটারে সংরক্ষণ করবে এবং তথ্য লাভের সুবিধার্থে সমগ্র দেশে নেটওয়ার্কের মাধ্যমে তার সংযোগ স্থাপন করবে। তথ্য কমিশন, প্রবিধান দ্বারা, কর্তৃপক্ষ কর্তৃক তথ্য সংরক্ষণ ও ব্যবস্থাপনার জন্য অনুসরণীয় নির্দেশনা প্রদান করবে এবং সকল কর্তৃপক্ষ তা অনুসরণ করবে।
তথ্য প্রকাশঃ
প্রত্যেক কর্তৃপক্ষ তার গৃহীত সিদ্ধান্ত, কার্যক্রম কিংবা সম্পাদিত বা প্রস্তাবিত কর্মকান্ডের সকল তথ্য নাগরিকগণের নিকট সহজলভ্য হয়, এরূপে সূচিবদ্ধ করে প্রকাশ ও প্রচার করার কথা বলা হয়েছে এ আইনে। তথ্য প্রকাশ ও প্রচারের ক্ষেত্রে কোনো কর্তৃপক্ষ কোনো তথ্য গোপন করতে বা তার সহজলভ্যতাকে সঙ্কুচিত করতে পারবে না। প্রত্যেক কর্তৃপক্ষ প্রতিবছর একটি প্রতিবেদন প্রকাশ করবে যাতে নিম্নলিখিত তথ্যসমূহ অন্তর্ভুক্ত থাকবে, যথা :- (ক) কর্তৃপক্ষের সাংগঠনিক কাঠামোর বিবরণ, কার্যক্রম, কর্মকর্তা-কর্মচারীগণের দায়িত্ব এবং সিদ্ধান্ত গ্রহণ প্রক্রিয়ার বিবরণ বা পদ্ধতি; (খ) কর্তৃপক্ষের সকল নিয়ম-কানুন, আইন, অধ্যাদেশ, বিধিমালা, প্রবিধানমালা, প্রজ্ঞাপন, নির্দেশনা, ম্যানুয়্যাল, ইত্যাদির তালিকাসহ উহার নিকট রক্ষিত তথ্যসমূহের শ্রেণী- বিন্যাস; (গ) কর্তৃপক্ষের নিকট হতে কোনো ব্যক্তি যে সকল শর্তে লাইসেন্স, পারমিট, অনুদান, বরাদ্দ, সম্মতি, অনুমোদন বা অন্য কোনো প্রকার সুবিধা গ্রহণ করতে পারবেন তার বিবরণ এবং উক্তরূপ শর্তের কারণে তার সাথে কোনো প্রকার লেনদেন বা চুক্তি সম্পাদনের প্রয়োজন হলে সে সকল শর্তের বিবরণ; (ঘ) নাগরিকদের তথ্য অধিকার নিশ্চিত করার জন্য প্রদত্ত সুবিধাদির বিবরণ এবং দায়িত্বপ্রাপ্ত কর্মকর্তার নাম, পদবী, ঠিকানা এবং, প্রযোজ্য ক্ষেত্রে, ফ্যাক্স নম্বর ও ই-মেইল ঠিকানা। কর্তৃপক্ষ গুরুত্বপূর্ণ কোনো নীতি প্রণয়ন বা সিদ্ধান্ত গ্রহণ করলে ওই সব নীতি ও সিদ্ধান্ত প্রকাশ করবে এবং, প্রয়োজনে, ওইসব নীতি ও সিদ্ধান্ত গ্রহণের সমর্থনে যুক্তি ও কারণ ব্যাখ্যা করবে। এই ধারার অধীন কর্তৃপক্ষ কর্তৃক প্রণীত প্রতিবেদন বিনামূল্যে সর্বসাধারণের পরিদর্শনের জন্য সহজলভ্য করতে হবে এবং তার কপি নামমাত্র মূল্যে বিক্রয়ের জন্য মজুদ রাখতে হবে। কর্তৃপক্ষ কর্তৃক প্রকাশিত সকল প্রকাশনা জনগণের নিকট উপযুক্ত মূল্যে সহজলভ্য করতে হবে। কর্তৃপক্ষ জনগুরুত্বপূর্ণ বিষয়াদি প্রেস বিজ্ঞপ্তির মাধ্যমে অথবা অন্য কোনো পন্থায় প্রচার বা প্রকাশ করবে। তথ্য কমিশন, প্রবিধান দ্বারা, কর্তৃপক্ষ কর্তৃক তথ্য প্রকাশ, প্রচার ও প্রাপ্তির জন্য অনুসরণীয় নির্দেশনা প্রদান করবে এবং সকল কর্তৃপক্ষ তা অনুসরণ করবে।
তথ্য প্রকাশের গোপনীয়তাঃ
তবে কতিপয় তথ্য প্রকাশ বা প্রদান বাধ্যতামূলক নয়।এ আইনের অন্যান্য বিধানাবলীতে যা কিছুই থাকুক না কেন, কোনো কর্তৃপক্ষ কোনো নাগরিককে নিম্নলিখিত তথ্যসমূহ প্রদান করতে বাধ্য থাকবে না, যথাঃ – (ক) কোনো তথ্য প্রকাশের ফলে বাংলাদেশের নিরাপত্তা, অখণ্ডতা ও সার্বভৌমত্বের প্রতি হুমকি হতে পারে এরূপ তথ্য; (খ) পররাষ্ট্রনীতির কোনো বিষয় যার দ্বারা বিদেশি রাষ্ট্রের অথবা আন্তর্জাতিক কোনো সংস্থা বা আঞ্চলিক কোনো জোট বা সংগঠনের সাথে বিদ্যমান সম্পর্ক ক্ষুন্ন হতে পারে এরূপ তথ্য; (গ) কোনো বিদেশি সরকারের নিকট হতে প্রাপ্ত কোনো গোপনীয় তথ্য; কোনো তথ্য প্রকাশের ফলে কোনো তৃতীয় পক্ষের বুদ্ধিবৃত্তিক সস্পদের অধিকার ক্ষতিগ্রস্ত হতে পারে এরূপ বাণিজ্যিক বা ব্যবসায়িক অন্তর্নিহিত গোপনীয়তা বিষয়ক, কপিরাইট বা বুদ্ধিবৃত্তিক সম্পদ (Intellectual Property Right) সম্পর্কিত তথ্য; (ঘ) কোনো তথ্য প্রকাশের ফলে কোনো বিশেষ ব্যক্তি বা সংস্থাকে লাভবান বা ক্ষতিগ্রস্ত করতে পারে এরূপ নিম্নোক্ত তথ্য, যথাঃ- (অ) আয়কর, শুল্ক, ভ্যাট ও আবগারী আইন, বাজেট বা করহার পরিবর্তন সংক্রান্ত কোনো আগাম তথ্য; (আ) মুদ্রার বিনিময় ও সুদের হার পরিবর্তনজনিত কোনো আগাম তথ্য; (ই) ব্যাংকসহ আর্থিক প্রতিষ্ঠানের পরিচালনা ও তদারকি সংক্রান্ত কোনো আগাম তথ্য; (চ) কোনো তথ্য প্রকাশের ফলে প্রচলিত আইনের প্রয়োগ বাধাগ্রস্ত হতে পারে বা অপরাধ বৃদ্ধি পেতে পারে এরূপ তথ্য; (ছ) কোনো তথ্য প্রকাশের ফলে জনগণের নিরাপত্তা বিঘ্নিত হতে পারে বা বিচারাধীন মামলার সুষ্ঠু বিচার কার্য ব্যাহত হতে পারে এরূপ তথ্য; (জ) কোনো তথ্য প্রকাশের ফলে কোনো ব্যক্তির ব্যক্তিগত জীবনের গোপনীয়তা ক্ষুন্ন হতে পারে এরূপ তথ্য; (ঝ) কোনো তথ্য প্রকাশের ফলে কোনো ব্যক্তির জীবন বা শারীরিক নিরাপত্তা বিপদাপন্ন হতে পারে এরূপ তথ্য; (ঞ) আইন প্রয়োগকারী সংস্থার সহায়তার জন্য কোনো ব্যক্তি কর্তৃক গোপনে প্রদত্ত কোনো তথ্য; (ট) আদালতে বিচারাধীন কোনো বিষয় এবং যাহা প্রকাশে আদালত বা ট্রাইব্যুনালের নিষেধাজ্ঞা রয়েছে অথবা যার প্রকাশ আদালত অবমাননার শামিল এরূপ তথ্য; (ঠ) তদন্তাধীন কোনো বিষয় যার প্রকাশ তদন্ত কাজে বিঘ্ন ঘটাতে পারে এরূপ তথ্য; (ড) কোনো অপরাধের তদন্ত প্রক্রিয়া এবং অপরাধীর গ্রেফতার ও শাস্তিকে প্রভাবিত করতে পারে এরূপ তথ্য; (ঢ) আইন অনুসারে কেবল একটি নির্দিষ্ট সময়ের জন্য প্রকাশের বাধ্যবাধকতা রয়েছে এরূপ তথ্য; (ণ) কৌশলগত ও বাণিজ্যিক কারণে গোপন রাখা বাঞ্ছনীয় এরূপ কারিগরী বা বৈজ্ঞানিক গবেষণালব্ধ কোনো তথ্য; (ত) কোনো ক্রয় কার্যক্রম সম্পূর্ণ হওয়ার পূর্বে বা উক্ত বিষয়ে সিদ্ধান্ত গ্রহণের পূর্বে সংশ্লিষ্ট ক্রয় বা তার কার্যক্রম সংক্রান্ত কোনো তথ্য ; (থ) জাতীয় সংসদের বিশেষ অধিকার হানির কারণ হতে পারে এরূপ তথ্য; (দ) কোনো ব্যক্তির আইন দ্বারা সংরক্ষিত গোপনীয় তথ্য; (ধ) পরীক্ষার প্রশ্নপত্র বা পরীক্ষায় প্রদত্ত নম্বর সম্পর্কিত আগাম তথ্য; (ন) মন্ত্রিপরিষদ বা, ক্ষেত্রমত, উপদেষ্টা পরিষদের বৈঠকে উপস্থাপনীয় সার-সংক্ষেপসহ আনুষঙ্গিক দলিলাদি এবং উক্তরূপ বৈঠকের আলোচনা ও সিদ্ধান্ত সংক্রান্ত কোনো তথ্য।
তবে শর্ত থাকে যে, মন্ত্রিপরিষদ বা, ক্ষেত্রমত, উপদেষ্টা পরিষদ কর্তৃক কোনো সিদ্ধান্ত গৃহীত হওয়ার পর অনুরূপ সিদ্ধান্তের কারণ এবং যেসকল বিষয়ের উপর ভিত্তি করে সিদ্ধান্তটি গৃহীত হয়েছে তা প্রকাশ করা যাবেঃ আরো শর্ত থাকে যে, এই ধারার অধীন তথ্য প্রদান স্থগিত রাখার ক্ষেত্রে সংশ্লিষ্ট কর্তৃপক্ষকে তথ্য কমিশনের পূর্বানুমোদন গ্রহণ করতে হবে।
